GENERAL TERMS AND CONDITIONS OF SALE

1. General Provisions and Scope
1.1. These General Terms and Conditions (the “Terms”) apply to all contracts for the sale of goods concluded at a distance via the online store https://4kidspoint.com/ (the “Store”) between GRUPA SILESIA Aleksandra Bałon, ul. A. Brody 79, 43-450 Ustroń, Poland, e-mail: info@4kidspoint.com, VAT ID: PL5482585928, Polish packaging register (BDO) number: 000066323, represented by Aleksandra Bałon (the “Seller”), and the buyer (the “Buyer”).
1.2. The Store is directed at Buyers with a delivery address in those Member States of the European Union to which the Seller offers delivery. The current list of delivery countries is available at https://4kidspoint.com/policies/shipping-policy. Information on the Seller’s registrations under extended producer responsibility schemes (e.g. packaging) in the individual Member States will be provided on request at info@4kidspoint.com.
1.3. These Terms contain in part different provisions for consumers and for business customers.
1.4. A consumer is any natural person who concludes a contract with the Seller for purposes which are outside their trade, business, craft or profession.
1.5. A business customer is any natural or legal person, or an organisational unit with legal capacity, who concludes a contract with the Seller for purposes relating to their trade, business, craft or profession.
1.6. The provisions of these Terms concerning consumers also apply to a natural person who concludes a contract directly connected with their business activity where the contract is not of a professional nature for that person, as follows in particular from the subject of their business activity disclosed in the Polish Central Register and Information on Economic Activity (CEIDG), to the extent provided for by the Polish Civil Code and the Polish Consumer Rights Act.
1.7. Terms and conditions of a business customer which conflict with or deviate from these Terms shall not apply unless the Seller has expressly agreed to them in writing or in electronic form. Supplementary agreements and/or side agreements are only valid with the Seller’s express consent.
1.8. Nothing in these Terms excludes or limits any rights to which consumers are entitled under mandatory law. Where the mandatory consumer protection provisions of the country in which the consumer has their habitual residence are more favourable to the consumer than these Terms or the law chosen in Section 11.1, those more favourable provisions shall prevail.
2. Offer and Conclusion of the Contract
2.1. The presentation of products in the Store does not constitute a legally binding offer but merely an invitation to place an order (catalogue offers). The Buyer may place one or more items in the virtual shopping cart. When opening the shopping cart, the Buyer enters the checkout process.
After entering the personal details and other information required to process the order, the Buyer places a binding order for the goods listed on the order page by clicking the button labelled “Order with obligation to pay” (or a correspondingly unambiguous wording). The Seller will confirm receipt of the order by e-mail without delay. This confirmation of receipt does not yet constitute acceptance of the order. The contract of sale is concluded when the Seller confirms by e-mail that the order has been positively verified and accepted for execution.
2.2. The text of the contract is stored on the Seller’s internal systems. These Terms can be viewed at any time at https://4kidspoint.com/policies/terms-of-service. A summary of the order, these Terms and the information on the right of withdrawal are sent to the Buyer by e-mail (on a durable medium) together with the order confirmation.
3. Gift Cards and Loyalty Programme
3.1. Gift cards which can be purchased via the Store https://4kidspoint.com (“Gift Cards”) can only be redeemed in the Seller’s online stores, unless the Gift Card states otherwise. They are activated upon order, payment and delivery of the Gift Card by e-mail.
3.2. Gift Cards and remaining balances of Gift Cards can be redeemed until the end of the third year following the year in which the Gift Card was purchased.
3.3. Gift Cards can only be redeemed before completing the ordering process; subsequent offsetting is not possible. Remaining balances are credited to the customer until the expiry date. Several Gift Cards can be redeemed in one order. Gift Cards may be combined with discounts or promotions. Gift Cards can only be used to purchase goods and not to purchase further Gift Cards.
3.4. If the value of the Gift Card is insufficient to cover the order, the difference may be paid using one of the available payment methods.
3.5. The balance of a Gift Card is neither paid out in cash nor does it bear interest.
3.6. The Gift Card is transferable. The Seller may perform with discharging effect to the respective holder who redeems the Gift Card in the Store. This does not apply if the Seller has knowledge or grossly negligent lack of knowledge of the holder’s lack of entitlement, legal incapacity or lack of authority to represent.
3.7. The Seller operates a loyalty programme. Participation is voluntary and free of charge. The conditions of participation, in particular the earning and redemption of benefits, are set out in the separate Loyalty Programme Terms available in the Store.
3.8. If the Buyer withdraws from a contract or a contract is terminated, benefits granted in connection with that order may be adjusted in accordance with the Loyalty Programme Terms. The Buyer’s statutory rights remain unaffected.
4. Prices
4.1. All prices stated are final prices including the value added tax applicable in the country of delivery. Prices are displayed in the currency selected in the Store. The prices shown in the shopping cart and at checkout at the time of the order are binding.
4.2. Shipping costs are charged in addition when goods are dispatched. They are shown in the respective offer and at https://4kidspoint.com/policies/shipping-policy.
4.3. Within the scope of certain offers and promotions, shipping costs are waived by the Seller above a certain order value, which can be found at https://4kidspoint.com/policies/shipping-policy, provided that the order value, after deduction of any returns and discounts, still exceeds the promotional threshold. If, after a return, the order value no longer exceeds the threshold, the Seller is entitled to charge the shipping costs subsequently.
4.4. Whenever the Seller announces a price reduction, it also indicates the lowest price applied to the product during the 30 days prior to the reduction.
4.5. For business customers established in another Member State of the European Union who provide a valid VAT identification number at checkout, the delivery may be invoiced as an intra-Community supply without Polish VAT (reverse charge), provided that the statutory requirements are met. The Seller verifies VAT numbers in the VIES system.
5. Delivery
5.1. The delivery time is stated in the respective product information. Goods are prepared for dispatch and shipped only after receipt of payment. Unless otherwise stated in the product description, the delivery time is up to 10 working days. Unless a different delivery address is specified, the goods are delivered to the billing address. If the Buyer wishes to receive the goods on a different date or outside regular delivery hours, the Buyer shall contact the Seller’s customer service in advance.
5.2. Goods are shipped from Poland. Deliveries are managed by Paxy Courier, ul. Boczna 8, 44-240 Żory, Poland, and carried out – depending on the country of delivery – by DPD or InPost.
5.3. If the carrier returns the goods to the Seller because delivery was not possible, the Buyer bears the costs of the unsuccessful shipment. This does not apply if the Buyer effectively exercises the right of withdrawal, is not responsible for the circumstances that made delivery impossible, or was temporarily prevented from accepting the delivery, unless the Seller had announced the delivery a reasonable time in advance.
5.4. The Seller is entitled to make partial deliveries where this is reasonable for the Buyer. For consumers this applies only if the partial delivery does not cause the consumer to lose interest in the contract as a whole. In the event of a dispute, the burden of proof lies with the Seller. Additional shipping costs for partial deliveries are only charged if expressly agreed. A partial delivery within the meaning of these Terms is the delivery of one order in several shipments.
5.5. If the Buyer is a consumer, the Seller bears the risk of accidental loss or damage during shipment, irrespective of the shipping method, unless the consumer has commissioned the carrier or forwarder without the Seller having nominated that carrier. If goods are delivered with obvious transport damage, the Buyer is asked to contact the Seller immediately at the e-mail address stated in Section 1.1. Failure to do so does not affect the consumer’s statutory rights.
5.6. If the Buyer is a business customer, the risk passes to the Buyer as soon as the Seller has handed the goods over to the commissioned logistics partner.
6. Payment
6.1. The payment methods available for the respective country are displayed at checkout. Payments are processed by payment service providers, in particular Shopify Payments, PayPal, Klarna, Apple Pay and Przelewy24 (a service of PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, Poland). If a payment method is temporarily unavailable, this is at the sole discretion of the respective payment service provider. Payment is due immediately upon conclusion of the contract. For credit card payments, the Buyer’s card is charged upon completion of the order. In the event of an unjustified chargeback for which the Buyer is responsible, the Seller may charge the bank fees actually incurred.
6.2. In the event of late payment, the statutory provisions on default apply. Interest for late payment is charged at the statutory rate; vis-à-vis business customers, at the statutory rate of interest for late payment in commercial transactions.
6.3. The Buyer is only entitled to set-off if the counterclaims arise from the same contractual relationship or have been finally established by a court, are undisputed or have been acknowledged by the Seller.
6.4. A business customer is not entitled to a right of retention unless the counterclaims arise from the same contractual relationship, or they are undisputed, finally established by a court or ready for decision.
6.5. Upon dispatch of the goods, the Buyer receives an electronic invoice at the e-mail address provided with the order. The Buyer is responsible for checking that all data entered is correct and complete before submitting the order. A business customer who wishes to receive an invoice with a VAT identification number must enter it at checkout. A subsequent correction of the invoice is only possible if the invoice data does not match the data in the order form; a subsequent change of the invoice recipient (e.g. from a private to a business buyer or vice versa) is not possible, unless mandatory law provides otherwise.
7. Right of Withdrawal for Consumers
Consumers have the following right of withdrawal:
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If you have ordered multiple goods in one order and they are delivered separately, the withdrawal period expires 14 days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last good.
To exercise the right of withdrawal, you must inform us,
GRUPA SILESIA Aleksandra Bałon, ul. A. Brody 79, 43-450 Ustroń, Poland, e-mail: info@4kidspoint.com,
of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory. You can also use the withdrawal function in the Store (button “Withdraw from contract” in the footer) or the return request in your customer account (relevant order → “Request return”). If you use one of these options, we will send you an acknowledgement of receipt of your withdrawal on a durable medium (e.g. by e-mail) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. Please return the goods using the return label generated in the DPD return portal (https://rmp.dpdgroup.com/021/GRUPA_SILESIA); the goods are to be sent to the address shown on the return label. Please do not send goods to our registered office in Poland. If you wish to return the goods without using the DPD return portal, please contact us at info@4kidspoint.com and we will provide you with the return address.
You will have to bear the direct cost of returning the goods. If you use the DPD return label, the return shipping costs applicable to your country, as indicated on our Returns page, will be deducted from the refund.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Use protective outer packaging if necessary. If you no longer have the original packaging, please use suitable packaging to ensure sufficient protection against transport damage. This request is not a precondition for the effective exercise of the right of withdrawal.
7.2. Exclusion or premature expiry of the right of withdrawal. The right of withdrawal does not apply to contracts for:
•    the supply of goods made to the consumer’s specifications or clearly personalised;
•    the supply of goods which are liable to deteriorate or expire rapidly;
•    the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
•    the supply of goods which, after delivery, are by their nature inseparably mixed with other items;
•    the supply of alcoholic beverages, the price of which was agreed upon at the time of the conclusion of the contract, the delivery of which can only take place after 30 days and the actual value of which is dependent on market fluctuations;
•    the supply of sealed audio or video recordings or computer software which were unsealed after delivery;
•    the supply of digital content not supplied on a tangible medium if performance has begun with the consumer’s prior express consent and acknowledgement that the right of withdrawal is thereby lost.
7.3. Business customers have no statutory right of withdrawal, subject to Section 1.6.
8. Statutory Warranty and Liability
8.1. If the Buyer is a consumer, the statutory liability for lack of conformity of the goods applies (Directive (EU) 2019/771 as implemented in the applicable national law; under Polish law, the Polish Consumer Rights Act). The Seller is liable for any lack of conformity which exists at the time of delivery and becomes apparent within two years of delivery. The consumer is entitled to have the goods brought into conformity free of charge (repair or replacement) and, under the statutory conditions, to a price reduction or termination of the contract. Longer periods or further rights under the law of the consumer’s country of habitual residence remain unaffected.
8.2. The Seller takes the greatest care in preparing the offers in the Store https://4kidspoint.com. Obvious errors (e.g. typing errors) in manufacturer information, product descriptions and prices, as well as technical changes, remain reserved. The consumer’s statutory rights remain unaffected.
8.3. For contracts with business customers or legal persons under public law (this does not apply to persons referred to in Section 1.6), the following applies:
a. The Seller’s liability under the statutory warranty for defects (rękojmia, Articles 556 et seq. of the Polish Civil Code) is excluded in accordance with Article 558 § 1 of the Polish Civil Code. This does not apply if the Seller has fraudulently concealed the defect.
b. The Buyer shall inspect the goods upon delivery. Shortfalls in quantity and visible transport damage must be notified to the Seller within 4 days of delivery; otherwise the delivery is deemed approved.
c. Claims under a commercial guarantee provided by the manufacturer remain unaffected. Any support provided by the Seller in asserting such claims is voluntary and does not constitute an acknowledgement of liability.
d. The Seller’s liability for damages, irrespective of its legal basis, is limited to the gross value of the respective order. The Seller is not liable for lost profits, indirect or consequential damage, loss of data, loss of production or business interruption.
e. The exclusions and limitations set out in items a. and d. do not apply to damage caused intentionally, to damage resulting from injury to life, body or health, or to liability under mandatory product liability law.
f. The Buyer may not withhold payments on the grounds of an alleged defect or set off against such claims, unless the counterclaim is undisputed or has been finally established by a court.
8.4. If a manufacturer provides a commercial guarantee for a product, its terms are set out in the guarantee statement enclosed with the product or in the product description. A commercial guarantee does not affect the Buyer’s statutory rights.
9. Retention of Title
The goods delivered remain the property of the Seller until the purchase price has been paid in full.
10. Information for Consumers on Distance Contracts and Customer Information on Electronic Commerce
10.1. The Seller is not subject to any special codes of conduct.
10.2. The Buyer can identify input errors during the final review before submitting the order and correct them at any time before submitting the order using the editing function.
10.3. The essential characteristics of the goods and the period of validity of time-limited offers can be found in the individual product descriptions in the Store.
10.4. The language available for the conclusion of the contract is English. Mandatory national provisions on the language of consumer information remain unaffected.
10.5. The Buyer can save the contract text using the browser’s save function or print it using the browser’s print function. The contract text (consisting of the order data and these Terms) is also stored by the Seller and sent to the Buyer by e-mail after the conclusion of the contract. For security reasons, a non-registered Buyer can no longer view the order data via the internet after completion of the purchase.
10.6. Information on payment, delivery and performance can be found in the respective offer and under Shipping and Payment. The delivery period begins, in the case of payment in advance by bank transfer, on the day following the payment order and, for all other payment methods, on the day of the order. If the last day of the period falls on a Sunday or a public holiday at the place of delivery, the period ends on the next working day.
11. Final Provisions
11.1. These Terms and all contracts concluded between the Seller and the Buyer are governed by the law of the Republic of Poland, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If the Buyer is a consumer, this choice of law does not deprive the consumer of the protection afforded by the mandatory provisions of the law of the country in which the consumer has their habitual residence; where those provisions are more favourable to the consumer, they shall prevail.
11.2. If the Buyer is a business customer, the court having jurisdiction over the Seller’s registered office shall have exclusive jurisdiction; the Seller is also entitled to bring an action at the Buyer’s registered office. For actions brought by or against consumers, the rules on jurisdiction of Regulation (EU) No 1215/2012 apply; in particular, consumers may also bring proceedings in the courts of the Member State in which they are domiciled.
11.3. Should individual provisions of these Terms be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the statutory provisions.
11.4. The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. In the case of cross-border disputes, consumers may obtain free advice from the European Consumer Centre (ECC-Net) in their country of residence.
11.5. The Seller may amend these Terms for valid reasons (in particular changes in the law or in the Store’s functionality). Orders placed before an amendment are governed by the version of the Terms in force at the time of the order.
12. Complaints
12.1. Contacting customer service. In the event of a complaint, please notify us via your customer account or by e-mail to info@4kidspoint.com, stating the order number and a description of the defect (photos, if possible). Complaints are handled quickly and without complications.
12.2. Returning the defective product. Depending on the product, we choose the simplest way to handle the complaint – collection by courier or a prepaid return label – at the Seller’s expense. Please do not send products without prior contact with customer service. Please, if possible:
•    hand over the product in its original packaging or other safe packaging so that it can be transported safely;
•    enclose all accessories supplied with the product (e.g. chargers, power supplies, cables);
•    enclose a detailed description of the defect.
12.3. Response to the complaint. The Seller will respond to a consumer’s complaint within 14 days of its receipt. If the Seller does not respond within this period, the complaint is deemed to be accepted.
12.4. Checking the parcel. We only offer high-quality, brand-new, originally packaged products from renowned manufacturers. When collecting your order, please check the condition of the parcel. If you notice any damage to the packaging, please have a damage report drawn up in the presence of the courier; this facilitates the handling of the complaint. This is not a precondition for your statutory rights.
